Release discharge & indemnity

1.1 I unconditionally release and discharge All Year Biker.co.uk, their agents and any persons acting on their behalf as ‘Host’ from all liabilities, claims and causes of action that may occur from any act, omission, default, failure or error on the part of All Year Biker.co.uk, their agents and any persons acting on their behalf as ‘Host’ (including any negligent act, omission, default, failure or error) occurring wholly or partially during the course of the activities.

Indemnity

2.1 I agree to indemnify and keep indemnified All Year Biker.co.uk, their agents and any person acting on their behalf as ‘Host’ from any liability, claim or cause of action that may be brought against All Year Biker.co.uk, their agents and any person acting on their behalf as ‘Host’ as a result of or in connection with any act, omission, default, failure or error on the part of All Year Biker.co.uk, their agents and any person acting on their behalf as ‘Host’ (Including any negligent act, omission, default, failure or error on the part of All Year Biker.co.uk, their agents and any person acting on their behalf as ‘Host’ occurring wholly or partially during the course of their activities).
3.2 I agree that All Year Biker.co.uk, their agents and any person acting on their behalf as ‘Host’ will not be liable for and waive any right to claim any loss or damage, economic loss or consequential loss whether in tort, in contract, under statute or otherwise, for any default, failure, negligence or error on the part of All Year Biker.co.uk, their agents and any person acting on their behalf as ‘Host’.

Bookings

4.1 All information submitted to All Year Biker.co.uk on the Booking Request Forms will be dealt with under the terms of the All Year Bikers.co.uk Privacy Policy and will not be released or disclosed to any third party or agent.
4.2 Acceptance of booking will be confirmed either by email or telephone, such acceptance is not a guarantee that an event or venue will take place. Circumstances beyound our control may result in an event or venue being cancelled or postponed.
4.3 Where a booking has been accepted and a time slot allocated for treatment, these times are approximate. Whilst every effort will be made to adhere to the arranged time, conditions on the day may affect the time slot allocated.

Cancellations

5.1 All Year Biker.co.uk may at it’s discretion cancel a Booking, Event or Venue. This may be due to a number of reason including poor weather conditions, lack of or cancelled bookings. Where such a cancellation occurs All Year Biker.co.uk will endeavour to notify those clients affected at the earliest opportunity. All Year Biker can accept no responsibility, and will not be liable for any claims, for inconvenience or time lost as a result of such cancellations.
5.2 Venue dates and times are allocated on the basis of Booking numbers, any client wishing to cancel a Booking is requested to do so at the earliest opportunity by contacting All Year Biker.co.uk by either the email or telephone information supplied when their Booking was confirmed.

Cancellation and Refund Policy: On-line Payments

If you cancel your appointment or fail to show:

6.2 AllYearBiker is a service run by bikers for bikers, as such we appreciate that circumstances and conditions unique to motorbikes can arise that prevent you from being able to attend the venue or your appointment date. If you are unable to attend we would ask that you notify us as soon as possible via the contact information sent to you by email. We will then get in touch with you and offer you a choice of options.

If you booked at a Venue:

If we cancel your appointment or venue:

6.1 Under the Consumer Protection (Distance Selling) Regulations you are entitled to a ‘cooling off period’ within 7 days of the date of placing your order. During this period you have the right to cancel your order and receive a full refund of any monies paid in respect of your order for goods or services. Cancellations can be made in writing via email to accounts@allyearbiker.co.uk . Upon receipt of your cancellation a refund will be made to your original payment method usually on the day of request. Please note it can take up to 30 days for the refund to appear on some credit/debit card statements.

A number of the venues we operate at are repeated at a later date and new venue locations may be arranged in your area. You can choose to maintain your booking and we will ensure you are allocate a place at the next available venue location. If you choose this option please be aware that it may be several weeks before the next venue becomes available. You may still request a refund at any time if you feel nothing suitable can be offered to you.

You can maintain your booking and request an alternative date for us to attend. This can usually be arranged within a few weeks or even days of your original appointment. You may still request a refund at any time if you feel nothing suitable can be offered to you.

If you booked with an Operator:

If neither of the above options are suitable for you then you can request a refund. In the case of multiple bookings and payments you will be refunded for those motorbikes that failed to turn up for treatment, (e.g. if you booked and payed for 4 x motorbikes and only two attended for treatment, you would be refunded for the two that cancelled). Refunds are returned to the original payment method usually on the day of request, if you paid by credit/debit card any refund will be made to this card. Please note it can take up to 30 days for the refund to appear on some credit/debit card statements.

Whilst we will always endeavour to honour any arrangments made, circumstance may occur that are outside of our control were we are forced to cancel your appointment or a venue. In this event we will notify you at the earliest possible opportunity via the contact information you supplied at the time of booking. Where possible we will offer you the same options as shown above, you can still request a refund at any time in which case any monies will be refunded in full to the original payment method usually on the day of request. Please note that it can take up to 30 days for the refund to appear on some credit/debit card statements.
